Terms of Service

These Terms of Service form a legal agreement between you and Cumberland Built, the operator of the Cumberland Leads service. By signing up, paying for, or using Cumberland Leads, you agree to these terms. If you do not agree, do not use the service.

Cumberland Leads keeps an eye on publicly available activity in your local area, scores how relevant each request is to your trade, and forwards the strongest matches to you by email, with SMS coming soon. The service is provided as is and is not a guarantee of customer acquisition.

Cumberland Leads is offered on a monthly recurring subscription billed through Stripe. Your subscription renews automatically each month until you cancel. You may cancel at any time from the billing portal linked in your dashboard; cancellation takes effect at the end of the current billing period and is not prorated.

Pricing is shown on the pricing page and may change with at least 30 days notice to active subscribers.

Subscription fees are non refundable except where required by law or at our sole discretion when a clear service failure has occurred.

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to provide accurate contact information and to keep it current.

You agree not to:

• Use the service for any unlawful, fraudulent, or harassing purpose
• Resell, redistribute, or share Cumberland Leads alerts with third parties as if they were your own product
• Attempt to reverse engineer, harvest data from, or circumvent technical protections of the service
• Use the service to send unsolicited bulk communications or to violate the terms of any third party platform

Program. If you opt in, Cumberland Leads sends recurring automated text messages to the mobile number you provide. The program includes two types of messages: (1) activity alerts when a matching local request is found, and (2) account and billing notifications, such as trial reminders or payment issues.

Consent. You opt in by checking the SMS consent box at sign up. Consent to receive automated texts is not a condition of purchase or of using Cumberland Leads. You may use the service with email delivery only.

Frequency. Message frequency varies based on your account activity and local match volume.

Cost. Message and data rates may apply. Cumberland Leads does not charge for the messages themselves; your mobile carrier’s standard rates apply.

Help and opt-out. Reply HELP for help, or STOP at any time to cancel and stop receiving texts. Opting out is free. You can also disable email delivery from your dashboard.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Alerts are derived from publicly available activity in your local area. We do not own or control that content and are not responsible for its accuracy or for any outcome of you contacting the person who made the request.

Cumberland Leads, Cumberland Built, the logo, and the service are owned by Cumberland Built. You receive a limited, non transferable, revocable license to use the service for your own business purposes during your active subscription.

We work to keep Cumberland Leads available and accurate, but we do not guarantee uninterrupted service. The service may be affected by maintenance, third party outages, or changes by upstream platforms. We are not liable for missed alerts due to outages outside our reasonable control.

The service is provided on an as is and as available basis, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, or non infringement.

To the maximum extent permitted by law, Cumberland Built and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the service. Our total liability under these terms in any 12 month period will not exceed the amount you paid for the service in that period.

You may stop using and cancel Cumberland Leads at any time. We may suspend or terminate your access if you violate these terms, fail to pay, or use the service in a way that creates risk for us or other users.

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Putnam County, Tennessee.

We may update these terms from time to time. When we do, we will update the “Last updated” date and, for material changes, notify active subscribers by email. Your continued use of the service after such notice constitutes acceptance.
